Estate Planning
What is Estate Planning?
Estate planning is the process of creating a will, trust, and other legal documents that will ensure your assets are divided in accordance with your wishes after you die. Estate planning can help you avoid probate, which is the official process of transferring property from one person to another. It can also help ensure that your loved ones are able to take care of you and your property while you are alive but incapacitated (unable to handle your affairs due to a physical or mental disability).
Why is Estate Planning Important?
Estate planning is an important step in protecting yourself and your loved ones after you die or while you are alive but incapacitated (unable to handle your own affairs due to a physical or mental disability). It can help avoid difficult and expensive disputes while you are incapacitated and after you die, as well as keep your assets available to your loved ones. There are many things you are able to accomplish with comprehensive estate planning – your estate planning goals likely depend on your unique life and circumstances. To better understand those possibilities, speaking to an Estate Planning Attorney is a great first step.
What is the Estate Planning process?
Every estate planning attorney may have a slightly different estate planning process. Here at Jasmine Gomez Law, the estate planning process can be described through four steps:
1) Initial Consultation: During this video/phone meeting, you and the attorney have the opportunity to meet and determine if we are the best fit to meet your legal needs. Here, the attorney will have the opportunity to go over the main documents used in estate planning and provide other helpful information for you to consider as you make the decision to start the estate planning process.
2) Design Meeting: Once you have retained Jasmine Gomez Law to meet your legal needs, you and the attorney will meet in-person to discuss the different things to consider when estate planning. At the end of this meeting, you will have an understanding of what provisions are to be included in your estate plan and what you can expect as a final product.
3) Review of Drafts: You will have the opportunity to review the drafted documents the attorney prepared and confirm the information as your estate plan.
4) Meeting to Execute Documents: During this meeting, your documents will be signed/executed. You will be provided with the originals and a copy of all documents for your records and reference.
